1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Landlord", "Tenant", or "you") and FairRentalAI ("Company", "we", "us", or "our"), governing your access to and use of the FairRentalAI platform, website, and services (collectively, the "Service") available at fairrentalai.com.

By creating an account, submitting an application, uploading documents, or otherwise using the Service, you represent that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them and all applicable laws and regulations.

These Terms apply to all users of the Service regardless of jurisdiction, including users in all provinces and territories of Canada (Alberta, British Columbia, Manitoba, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, Ontario, Prince Edward Island, Quebec, Saskatchewan, Yukon) and all states and territories of the United States of America.

2. Description of Service

FairRentalAI provides an AI-assisted tenant screening and rental application management platform. The Service allows landlords to create property listings, collect rental applications from prospective tenants, receive AI-generated applicant scores and summaries, manage document collection, and communicate decisions to applicants.

FairRentalAI is a technology platform only. We are not a real estate broker, property manager, credit bureau, background check provider, legal advisor, or financial advisor. We do not make rental decisions on behalf of landlords. All decisions regarding tenant selection are made solely by the landlord.

3. AI Scoring — Disclaimer and Limitations

The AI scoring system provided by FairRentalAI generates automated scores and summaries based on information voluntarily submitted by applicants. These scores are provided for informational and organizational purposes only and constitute one input among many that a landlord may consider.

• AI scores are NOT a substitute for professional credit checks, background checks, reference checks, or legal due diligence.
• AI scores are based solely on self-reported information and are NOT verified by FairRentalAI.
• FairRentalAI does not guarantee the accuracy, completeness, or fitness for purpose of any AI score or summary.
• Landlords are solely responsible for verifying applicant information independently before making any rental decision.
• FairRentalAI expressly disclaims all liability for any rental decision made in reliance on AI scores.
• AI scores do not consider race, color, national origin, religion, sex, familial status, disability, age, sexual orientation, gender identity, or any other protected characteristic under applicable human rights legislation.

The AI scoring system is powered by third-party artificial intelligence technology. FairRentalAI does not warrant that the AI system is free from errors, biases, or technical failures.

4. Fair Housing and Human Rights Compliance

Landlords using FairRentalAI are solely and exclusively responsible for compliance with all applicable fair housing, anti-discrimination, and human rights laws, including without limitation:

• Canada: The Canadian Human Rights Act, provincial Human Rights Codes in all provinces and territories, and the Canadian Charter of Rights and Freedoms as applicable.
• United States: The Fair Housing Act (42 U.S.C. §§ 3601–3619), Title VIII of the Civil Rights Act of 1968, the Americans with Disabilities Act, and all applicable state and local fair housing laws.

FairRentalAI does not accept liability for any discriminatory rental decisions made by landlords using the platform. Landlords who use AI scores, application data, or any feature of the platform to discriminate against applicants on the basis of any protected characteristic do so in violation of these Terms and applicable law, and bear sole and exclusive liability for such actions.

FairRentalAI reserves the right to immediately terminate the account of any landlord found to be using the platform for discriminatory purposes.

5. No Refund Policy

FairRentalAI charges a one-time fee of $5.00 CAD (for Canadian users) or $5.00 USD (for users in the United States and all other countries) for each additional property listing beyond the five (5) free listings included in every account.

This fee is charged at the time of property creation and is non-refundable under any circumstances, including but not limited to:

• Change of mind or decision not to use the property listing
• Failure to attract suitable applicants
• Technical issues on the user's device or internet connection
• Account closure or termination
• Dissatisfaction with AI scoring results
• Duplicate payments made in error

The Service is provided on an as-is basis. Payment of the property listing fee does not guarantee any particular number of applications, AI scoring quality, or tenant placement outcome.

If you believe a payment was made fraudulently or without your authorization, you must contact us at info@fairrentalai.com within 7 days of the charge. We reserve the right to investigate and make a final determination at our sole discretion.

6. No Property Editing After Creation

Once a property listing has been created and an application link has been shared or made available to prospective tenants, the core listing details (address, unit type, monthly rent) cannot be modified. This policy exists to protect applicants who submitted their application based on the original listing details.

Landlords acknowledge and agree that:

• They are responsible for ensuring all property details are accurate before creating a listing.
• FairRentalAI is not liable for any losses arising from an error in a property listing.
• If a material error is made, the landlord's sole remedy is to create a new property listing (which may incur an additional fee if the free limit has been reached).

7. Document Storage and Deletion

Tenant documents uploaded to FairRentalAI (including pay stubs, government-issued identification, bank statements, and other supporting documents) are stored securely using encrypted cloud storage. The following data retention policies apply:

• All documents associated with a finally-approved application will be permanently and irreversibly deleted from FairRentalAI servers within thirty (30) calendar days of the final approval date.
• Documents associated with declined applications may be deleted at any time at FairRentalAI's discretion.
• Landlords are solely responsible for downloading and retaining any documents they require for legal, tax, or compliance purposes before the 30-day deletion period expires.
• FairRentalAI bears no liability for any loss, damage, or consequence arising from the deletion of documents pursuant to this policy.

Documents are stored in a private, encrypted storage system and are not accessible to the public. Only the landlord associated with the relevant property may access documents via authenticated pre-signed URLs that expire after 15 minutes.

8. Tenant Data and Privacy

Tenants who submit applications through FairRentalAI consent to the collection, storage, and processing of their personal information for the purpose of rental application screening. This includes name, contact information, employment details, financial information, and uploaded documents.

Tenant personal information is shared exclusively with the landlord who created the property listing to which the tenant applied. FairRentalAI does not sell, rent, or share tenant data with third parties except as required by law or as necessary to provide the Service (including AI processing and cloud storage providers).

Tenants acknowledge that the accuracy of AI-generated scores depends on the accuracy of information they provide, and that providing false or misleading information may result in an inaccurate score and may constitute fraud.

9. Landlord Responsibilities and Representations

By using FairRentalAI as a landlord, you represent, warrant, and agree that:

• You are the legal owner or authorized agent of any property you list on the platform.
• All property information you provide is accurate and not misleading.
• You will comply with all applicable landlord-tenant laws in your jurisdiction, including required notice periods, security deposit regulations, and lease requirements.
• You will not use the platform to discriminate against applicants based on any protected characteristic.
• You will independently verify applicant information before making rental decisions.
• You will keep applicant personal information confidential and not share it with unauthorized third parties.
• You will download and securely retain any documents required for legal compliance before FairRentalAI's deletion period expires.
• You understand that FairRentalAI AI scores are not a substitute for formal credit or background checks.

10. Limitation of Liability

In no event shall FairRentalAI's total aggregate liability to you for all claims arising out of or related to these Terms or the Service exceed the greater of (a) the total amount paid by you to FairRentalAI in the twelve (12) months preceding the claim, or (b) $25.00 CAD.

FairRentalAI is not liable for:

• Any rental decision made by a landlord, including decisions that result in legal action, financial loss, or property damage.
• The accuracy of information submitted by tenants or landlords.
• The accuracy, reliability, or fitness for purpose of AI-generated scores or summaries.
• Any loss arising from a tenant's failure to upload documents or meet application requirements.
• Any data loss, including documents deleted pursuant to the 30-day retention policy.
• Service interruptions, technical failures, or downtime.
• Third-party services including Stripe, SendGrid, Cloudflare, Anthropic, or Railway.

11. Indemnification

You agree to defend, indemnify, and hold harmless FairRentalAI and its directors, officers, employees, agents, and partners from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any rental decision you make using information obtained through the Service; (e) any claim by a third party (including a prospective tenant) arising from your use of the Service.

12. Prohibited Uses

You agree not to use the Service to:

• Discriminate against applicants on the basis of any protected characteristic.
• List properties you do not own or are not authorized to rent.
• Submit false, fraudulent, or misleading information.
• Attempt to reverse-engineer, scrape, or extract data from the platform.
• Use automated scripts or bots to submit applications or interact with the platform.
• Harass, threaten, or harm other users.
• Violate any applicable law or regulation.
• Circumvent, disable, or interfere with security features of the platform.

13. Account Termination

FairRentalAI reserves the right to suspend or permanently terminate any account at any time, with or without notice, for any reason including but not limited to violation of these Terms, suspected fraudulent activity, or non-payment. Upon termination, your right to use the Service ceases immediately and all data associated with your account may be deleted.

No refunds will be issued upon account termination regardless of the reason for termination.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Calgary, Alberta, Canada for the resolution of any disputes arising out of or related to these Terms or the Service.

For users located in Quebec, Canada, nothing in these Terms limits any rights you may have under the Consumer Protection Act (Quebec) or other mandatory Quebec consumer protection legislation.

For users located in the United States, you agree that any dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, and you waive any right to a jury trial or class action proceeding.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FAIRRENTALAI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

16. Changes to Terms

FairRentalAI reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to fairrentalai.com/terms.html. Your continued use of the Service following any changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify registered users of material changes by email.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FairRentalAI regarding your use of the Service and supersede all prior agreements, understandings, and negotiations between the parties.
